Intended Use: CanABaby is designed **solely for scanning and assessing products that are marketed for babies and young children**. Do not scan products that are not meant for children and babies. For example:

AI Technology: CanABaby uses multiple artificial intelligence models including OpenAI and Google Gemini to process and analyze ingredient information. By using our service, you also agree to the terms of service of our AI providers:

3. Medical Disclaimer

4. OCR and Analysis Limitations

OCR Technology Limitations:

• Our optical character recognition (OCR) technology may miss ingredients due to poor image quality, lighting, or text formatting
• Small text, curved labels, reflective surfaces, or damaged packaging can prevent accurate ingredient detection
• Foreign languages, unusual fonts, or handwritten text may not be properly recognized
• Ingredients listed in fine print or on hidden areas of packaging may be missed
• We cannot detect ingredients that are not visible in the uploaded image

No Guarantee of Accuracy:

• We do not guarantee that our analysis captures all ingredients present in any product
• AI analysis may incorrectly interpret ingredient names or safety classifications
• Safety assessments are based on responses from third party AI models and may not be accurate
• Product formulations may change without notice, making previous analyses outdated

5. User Responsibilities and Age Requirements

As a user of CanABaby, you agree to:

• Use the service responsibly and not for commercial resale of our analysis
• Respect intellectual property rights and not reverse engineer our service
• Not attempt to overwhelm our servers with excessive automated requests

• Not use the service if prohibited by law in your jurisdiction

8. Indemnification

You agree to defend, indemnify, and hold harmless 99Tries OÜ, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of CanABaby and any decisions made based on our analysis
• Your violation of these Terms and Conditions
• Your violation of any third-party rights, including intellectual property rights
• Any content you upload or submit to our service
• Any harm caused to your child or others based on your use of our service
• Any false or misleading information you provide

9. Limitation of Liability and Warranties

Disclaimer of Warranties:

• CanABaby is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for purpose
• We do not warrant that the service will be uninterrupted, error-free, or secure
• We make no warranties about the accuracy, completeness, or reliability of our analysis
• No advice or information obtained from us creates any warranty not expressly stated

Limitation of Liability:

• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, goodwill, use, data, or other intangible losses
• We are not responsible for any harm to your child or others based on our analysis
• Users assume full responsibility for their use of the service and any resulting consequences
• Some jurisdictions do not allow liability exclusions, so some limitations may not apply

10. Intellectual Property

All content, features, and functionality of CanABaby are owned by us and protected by intellectual property laws:

• Our AI models and algorithms are proprietary technology
• The CanABaby name, logo, and branding are our trademarks
• Users retain rights to images they upload but grant us processing rights
• Analysis results are for personal use only

11. Termination

We reserve the right to terminate or suspend access to our service immediately, without prior notice, for any reason including:

• Fraudulent or abusive behavior

12. Dispute Resolution and Arbitration

Binding Arbitration:

• Any dispute arising from these terms or your use of CanABaby shall be resolved through binding arbitration
• Arbitration will be conducted under Estonian law and arbitration rules
• The arbitration shall take place in Estonia, unless otherwise agreed
• You waive your right to a jury trial and to participate in class action lawsuits
• Each party shall bear their own costs unless the arbitrator decides otherwise

Class Action Waiver:

YOU AND 99TRIES OÜ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You expressly waive any right to bring or participate in class action lawsuits, collective actions, or any other representative proceedings.

Exceptions:

Either party may seek injunctive relief in court to protect intellectual property rights or to enforce confidentiality obligations.

13. Service Availability and Force Majeure

Service Availability:

• We do not guarantee that CanABaby will be available 24/7 or without interruption
• We may suspend, modify, or discontinue the service at any time without notice
• We are not liable for any service downtime, maintenance, or technical issues
• Your access may be restricted due to geographic location or local laws

Force Majeure:

99Tries OÜ shall not be liable for any delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet outages, or failures of third-party services (including AI providers).

14. Severability and Entire Agreement

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be reformed to the minimum extent necessary to make it valid and enforceable.

Entire Agreement:

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and 99Tries OÜ regarding your use of CanABaby. They supersede all prior agreements, understandings, and communications.

No Waiver:

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Estonia. Any disputes not subject to arbitration will be resolved in the courts of Estonia.
